Online privacy notice

This statement sets forth the Privacy Policy ("Policy") of ReConvert Ltd. registered in Israel (together with its affiliated companies – "ReConvert", “we”, “us”, “our”).

ReConvert respects the privacy of its customers, vendors, users, and others, and is committed to protecting the Personal Data that they share with us. This Policy describes how ReConvert collects, uses, shares, secures and processes Personal Data in the course of providing its services, as specified below, and outlines the ways in which our customers can control our use of that information.
This Policy concerns personal data collected, received or used via ReConvert’s Services (as defined below), including, but not limited to, in ReConverts'  web application referring to this Policy (currently available:  https://www.reconvert.io/, reconvert.com, upsell.com stilyoapps.com and https://stilyoapps.info/o, collectively – "Application"), via ReConvert’s services, and other data sources as described below.

Note that those aspects of this Policy which are mandated by the EU General Data Protection Regulation (“GDPR”), in particular any rights (such as data subject rights detailed below) and duties conferred by GDPR, will apply only to the extent that GDPR applies. Capitalized terms not otherwise defined herein take their meaning in GDPR.

For the purposes of this Policy, Personal Data shall mean any information that can be used to identify, locate or contact an individual.

This Policy details how we collect, store and process Personal Data.

1. General

ReConvert provides its Customers (merchants) with web application solutions to support and improve merchant's stores operating on the Shopify Platform and/or the Wix Platform by providing Upsell and Cross-sell tools. The services support different types of  functionalities to fit the Customer's needs, such as: targeted upsell and cross sell offers and different store pages customization using widgets such as: personalized content pages, surveys, social sharing, upsell, video, birthday collector, etc. (together with the Application the "Services”). Customer shall mean an entity, organization or company operating an online store (merchants), that uses ReConvert’s Services.

For more information about our Services, please refer to our terms of use [link] (the “Terms of Use”). Capitalized terms not otherwise defined herein shall have the meaning given to them in the Terms of Use.

In this context, ReConvert is the “data processor” of Personal Data on behalf of its Customers, the “data controllers”, as these terms are defined under the GDPR.

Personal Data collected on our Customer's users ("Users") on behalf of the Customers, shall be processed by ReConvert in accordance with Customer's instructions and the ReConvert's needs as described below, and used to provide services consistent with those Customer instructions.

The collection, use and retention of Personal Data on behalf of our Customers is, at all times, controlled by the Customer, and any questions or requests with regard to a Customer’s privacy policy should be directed to that Customer.
However, with respect to data of contacts at its Customers or its contractors, ReConvert may be considered as the “data controller”.  ReConvert may process Personal Data as a “data controller” when you use the Application when you try a demo or trial of the Services or report any concerns as a Customer of the Application, and when you or your organization contact ReConvert with business relationship purposes.

If you are our Customer, User, or contractor (“you”), please read this Privacy Policy carefully and make sure that you fully understand and agree to it.

You are not legally required to provide us with any personal data, and may do so (or avoid doing so) at your own free will. If you do not wish to provide us with your personal data, or to have it processed by us or any of our Service Providers (defined below), please avoid any interaction with us including using our Services. If you are a user of the Services on behalf of any of our Customers, we suggest that you contact your account administrator with any questions.

2. Types of Data Collected

We collect Personal Data regarding our Customers, Users and contractors. Such data is typically collected and generated through your interaction with our Services, through automatic means, directly from you or through third parties. Specifically, we collect the following categories of data (which, to the extent it relates to an identified or identifiable individual, will be deemed as “Personal Data“):

(i) Customer's Users Data: Our Services provide our Customers with a wide verity of tools and features to better manage and optimize their Users’ experience and interaction. Such data relates to individuals who register to our Customer's services, place purchases on or otherwise interact with our Customer's online stores and to their interactions with our Services.
Our Customer is solely responsible for determining how to use our Services, and to ensure that the appropriate legal basis for the processing of its Users Data have been established, prior to having such data collected through the Services.
ReConvert processes Customer’s Users Data strictly on our Customer’s behalf, in accordance with their reasonable instructions and as further stipulated in our Data Processing Agreement and other commercial agreements with such Customer.
Accordingly, to the extent applicable by law, our Customer will be deemed the ‘data controller’ (e.g. under the EU GDPR, UK GDPR and similar laws) of such data; and ReConvert will be deemed the ‘data processor’ or ‘service provider’ when processing such data.

(ii) Customer Data: contact, contractual and billing details concerning our Customers, which may also contain the details of their internal focal persons who directly engage with us concerning their organizational account, and users of the Services on behalf of such Customers, e.g., the account administrators and users, billing contacts on behalf of the Customer; as well as the Customer’s needs and preferences, as identified to us or recognized through our engagement with them ("Customer Data”); we collect some or all of the following types of Personal Data of our Customers:
account information: full name, and e-mail address;
profile and contact information: name, title, team, merchant/store details, e-mail and phone number, and additional information submitted by a Customer.
Service usage information: connectivity, technical and aggregated usage data, such as, IP addresses, device data (like type, device id, browser version, locale and language settings used), activity logs, session recordings); we may collect or generate such data independently or with the help of third-party analytics tools.
direct interactions and communications with us: including recordings and transcripts of your calls, chats and emails with us, recordings of video-calls for demos, e.g. for support and training purposes.

(iii) Application Data: We collect and generate the following types of Personal Data concerning our Customers :
Application usage information – we may use third party analytics tools such as Google Analytics and Facebook Pixel, to automatically collect aggregated information about your use of the Application, e.g. connectivity, technical and aggregated usage data, such as user agent, IP addresses, device data (like type, device id, browser version, locale and language settings used), activity logs, session recordings, and the cookies and pixels installed or utilized on their device, including through the use of “cookies” and other tracking technologies (as further detailed below).
Direct interactions and communications with us – including recordings and transcripts of your calls, emails, form submissions and chats with us, e.g. for customer support, feedback, training purposes, etc.
We collect such data either automatically, through the data subject’s interaction with us or with our Application or Services; or through third party services, social media, analytics tools, and other business initiatives.

We may also collect non-personal data which consists of technical information and aggregated usage information, and may contain, among other things, the User’s operating system, type of browser, the period of time the User visited the Service and related timestamps, etc. Non-Personal Information shall be gathered by us in order to examine the Users’ interactions with the Services.  

Data minimization – we request our Customers and Users to use the Services only for the intended purpose solutions, and to avoid uploading excessive Personal Data.

3. Legal Basis for processing

ReConvert processes Personal Data on different legal bases:

  • Where ReConvert processes Personal Data as a data processor on behalf of its Customer which is the data controller, each Customer is solely responsible for establishing a legal basis for proceeding and providing adequate notice to their account users and customers whose data may be processed through the Services, as necessary to comply with all applicable privacy and data protection laws; and to obtain all approvals and consents from such individuals as required under such laws.
  • Where ReConvert is the data controller, ReConvert will process Personal Data only when we have one of the following grounds:
    • Consent;
    • Our legitimate interests in performing our contract with our Customer, vendor or other parties, and performing our obligations under that contract.
    • Where we have a legitimate interest, e.g. managing our business, or defending ourselves from claims, subject to such processing not overriding your own rights and freedoms;
    • Exceptionally, when necessary in the public interest, for example when law enforcement agencies request information to investigate a crime.

4. How ReConvert uses Personal Data

We may use the data we collect in the following ways:

  • To facilitate, operate and provide the Customer with the Services and use of the Services and to carry out our obligations arising from any contracts entered into between our Customer and us.
  • To authenticate the identity of our Services’ users and to allow them to access and use our Services;
  • To provide our Customers and users with assistance and support;
  • To contact our Customers, users and prospects with general or personalized service-related messages, as well as promotional messages that may be of specific interest to them; If you do not wish to receive such promotional communications, you may notify us at any time by sending an e-mail to  care@reconvert.com, or by following the "unsubscribe" instructions contained in the promotional communications you receive.
  • For analytics, statistical and research purposes, on an aggregated statistical basis in order to improve our Services, and to create aggregated statistical data, inferred non-personal data, or anonymized or pseudonymized data (rendered non-personal and non-identifiable);
  • To notify Customers and users about changes to our Services and provide information that is relevant to their use of the Services.
  • To support and enhance our data security measures, including for the purposes of preventing and mitigating the risks of fraud, error or any illegal or prohibited activity;
  • For compliance with a legal obligation (e.g., to respond to a court order or a regulator) ;
  • To protect our rights, privacy and security, safety, networks, systems and property, or those of other persons.
  • In order to exercise our rights, and to defend ourselves from claims and to comply with laws and regulations that apply to us or third parties with whom we work.

5. Disclosure of Personal Data

We may disclose Personal Data to third parties only in the following cases:

  • when we use third party service providers that are required for the performance of our business and Services, and who are bound by law or contract to protect the Personal Data and only use it in accordance with our instructions; for example - cloud computing provider for the storage of data, for analytics purposes, data security services, billing and payment processing services, e-mail and/or SMS distribution and monitoring services, call session or activity recording services, remote access services, data optimization and marketing services, social and advertising networks, support and customer relation management systems, legal, financial and compliance advisors etc.; 
  • We may share Personal Data with our affiliated companies, which may use it only for the purposes listed above.
  • if we are under a duty to disclose or share Personal Data in order to comply with any legal obligation, such as in response to a subpoena, including to law enforcement agencies and courts; 
  • Where needed to affect the sale, merger of our company or transfer of business assets, to enforce our rights, protect our property, or protect the rights, property or safety of others, or as needed to support external auditing, compliance and corporate governance functions. If we believe that such change in control might materially affect you, we will notify you of this event.
  • Please note that we may also use and disclose information that is not personally identifiable. For example, we may publish reports that contain aggregated and statistical data about our Customer’s Users. These reports do not contain any information that would enable the recipient to contact, locate or identify users. These reports also do not contain any identifiable company information. We may also use third-party analytics tools regarding such non-personal data in order to create analytics and reports and examine our Customers' and/or the Users' usage patterns.
  • Advertising Feature. If you enable the optional Advertising Feature, we may share limited, anonymized technical data concerning your Users (for example, hashed identifiers, impression or click metrics) with independent advertising providers (Ad Providers as defined in the Terms of Use) solely for the purpose of enabling, serving, measuring, and optimizing the delivery of third-party Advertisements. We do not use such data for any other purpose. The respective advertising providers carry out any further processing of such data in accordance with their own privacy policies. As between you and us, you are responsible for ensuring that you have provided all necessary notices to, and obtained all required consents or authorizations from, your Users with respect to the operation of the Advertising Feature and the sharing of such anonymized data.

6. International transfer

Since we operate globally, it may be necessary to transfer data, including Personal Data, to countries outside your country. We and our authorized service providers maintain, store and process Personal Data in the United States, Israel, European Union, and in other locations as reasonably necessary for the proper delivery and performance of our Services or as may be required by law. The data protection and other laws of these countries may not be as comprehensive as those in your country − in these instances, we will take steps to ensure that a similar level of protection is given to Personal Data, including through adequate contractual measures.  

7. Data storage and retention

We retain Customer’s User Data on our Customer’s behalf, in accordance with their reasonable instructions and according to ReConvert's reasonable business needs.

We retain our Customer Data and Application’s Data for as long as it is reasonably necessary in order to maintain and expand our relationship and provide you with our Services and offerings; in order to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes (i.e. as required by laws applicable to log-keeping, records and bookkeeping, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use), all in accordance with our data retention policy.

Please note that except as required by applicable law or our specific agreements with you, we will not be obligated to retain your data for any particular period, and we are free to securely delete it or restrict access to it for any reason and at any time, with or without notice to you.

8. Cookies and Tracking Technologies

We utilize "cookies", anonymous identifiers and other tracking technologies, which help us provide, secure and improve our Services, personalize your experience and monitor the performance of our activities.

A “cookie” is a small text file that is used, for example, to collect data about activity on our Application. Some cookies and other technologies serve to recall Personal Data, such as an IP address previously indicated by a Visitor.

Cookies are sent to your web browser and then sent back by the browser each time it accesses the server that sent the cookie. Some cookies are removed when you close your browser session. These are the “Session Cookies”. Some last for longer periods and are called “Persistent Cookies”. We use both types.

We use Persistent Cookies to remember your log-in details and make it easier for you to log-in the next time you access the Platform. We may use this type of cookies and Session Cookies for additional purposes, to facilitate the use of the Services’ features and tools.

Our web applications enable Customers to utilize "cookies" in relation to Users and in relation to the services they provide to Users. It is hereby clarified that in such cases, it is the Customer's responsibility to utilize "cookies" in accordance with applicable law.

Most browsers allow you to control cookies, including whether or not to accept them and to remove them. You may set most browsers to notify you if you receive a cookie, or to block cookies with your browser.

Please bear in mind that disabling cookies may complicate or even prevent you from using the Services.

9. Information security

ReConvert has implemented an information security program that contains administrative, technical and physical controls that are designed to safeguard Personal Data. We employ various technical and administrative measures to protect and maintain the security, integrity, and availability of your data, as applicable. Please note that while we take reasonable measures to safeguard your Personal Data, we cannot fully guarantee its security.

10. Children

We do not knowingly collect or otherwise process Personal Data from children under the age of 16. Please inform us if you believe we may be doing so in error, in which case we will, where possible, delete such data or otherwise ensure its lawful processing by ReConvert.

11. Data subject's rights

Where GDPR and other local laws apply, such laws stipulate data subjects’ various rights over their data. These rights may include the following, depending on the circumstances: rights to data portability, rights to access data, rights to rectify data, rights to object to processing, and the right to erase data. You may also have the right to lodge a complaint with a supervisory authority. 

These rights are to be met by the data controller, and will apply to ReConvert where it is a data controller. Where Personal Data is processed by ReConvert as a data processor, relevant data subjects’ rights must be asserted only through the Controller.  

If you would like to make any requests regarding Personal Data that we process on our Customer’s behalf, please contact the Customer directly

Please note that when you ask us, on our role as a data controller, to exercise any of your rights under this policy or applicable law, we may need to ask you to provide us certain credentials to make sure that you are who you claim you are, to avoid disclosure of Personal Data related to others. Such additional data will be then retained by us for legal purposes.

 

Note that if you do contact us in this regard, we may share your communications with the relevant customer and its account users; and that we may also share the contact details of the account administrator with individuals who sent us such a request or query relating to this account.

12. External Links

While our Services may contain links to other websites or services, we are not responsible for their privacy practices, and encourage you to pay attention when you leave our Services for the website or services of such third parties and to read the privacy policies of each and every website and service you visit. This Privacy Policy only applies to our Services.

13. Changes to this Policy

From time to time, we may update this Policy to reflect new or different privacy practices. The amended version will be effective as of the published date. We will place a notice online when we make material changes to this Policy. Additionally, if the changes will materially affect the way we use or disclose previously collected Personal Data, we will notify our Customers about the change by sending a notice to the primary email address associated with the Customer.
